Overview

Continues the State Board of Behavioral Health Examiners (Board) for 6 years.

History

Established in 1989, the Board was created to establish and maintain standards of qualifications and performance for licensed behavioral health professionals in the areas of counseling, marriage and family therapy, social work and addiction counseling and to regulate the practice of licensed behavioral health professionals for the protection of the public. Responsibilities of the Board include: 1) issuing and renewing licenses for qualified individuals; 2) establishing and collecting fees; and 3) keeping records of all licensed persons, applications, dispersed monies and the actions taken on licenses including the renewal, suspension, denial or revocation or probation of a licensee (A.R.S. § 32-3253).

The Board is comprised of eight professional members and four public members who are each appointed by the Governor (A.R.S. § 32-3252).

The Senate Health and Human Services and House Health & Human Services Committees of Reference (COR) met jointly on January 17, 2025 to conduct a review of the Board. The COR recommended the Board be continued for six years.

Provisions

1.   Continues, retroactive to July 1, 2025, the Board until July 1, 2031. (Sec. 2, 4)

Senate Amendments

Governor's Regulatory Review Council (GRRC)

1.   Continues, retroactive to July 1, 2025, GRRC for four years until July 1, 2029.

2.   Repeals GRRC on January 1, 2030.

3.   Mandates GRRC staff to review the Arizona Constitution and any relevant statutes and advise GRRC on the constitutionality of a rule independent of an agency's statutory justification for the rule.

4.   Permits GRRC to employ legal counsel and make an expenditure or incur indebtedness for legal services to implement, advise or defend GRRC's decision on the constitutionality of a rule.

5.   Requires GRRC to electronically distribute all nonprivileged GRRC meeting materials to the Governor, President of the Senate and Speaker of the House of Representatives at the same time that the materials are distributed to GRRC members.

6.   Stipulates that GRRC is only permitted to vote at GRRC meetings.

7.   Instructs GRRC to allot an equal amount of time to individuals who support or oppose a rule at council meetings that are open to the public.

8.   Modifies GRRC membership and appointment requirements.

9.   Contains a purpose clause.

Department of Insurance and Financial Institutions (DIFI)

10.  Continues, retroactive to July 1, 2025, DIFI for eight years until July 1, 2033.

11.  Repeals DIFI on January 1, 2034.

Arizona Board of Respiratory Care Examiners (ABRCE)

13.  Continues, retroactive to July 1, 2025, ABRCE for six years until July 1, 2031.

14.  Repeals ABRCE on January 1, 2032.

Arizona Board of Osteopathic Examiners in Medicine and Surgery (ABOEMS)

16.  Continues, retroactive to July 1, 2025, ABOEMS for six years until July 1, 2031.

17.  Repeals ABOEMS on January 1, 2032.

18.  Contains a purpose clause.

Arizona Board of Dental Examiners (ABDE)

19.  Continues, retroactive to July 1, 2025, ABDE for six years to July 1, 2031.

20.  Repeals ABDE on January 1, 2032

21.  Contains a purpose clause.

Board of Massage Therapy (BMT)

22.  Continues, retroactive to July 1, 2025, BMT for six years until July 1, 2031, rather than July 1, 2027.

23.  Repeals BMT on January 1, 2032, rather than January 1, 2028.

24.  Requires the Executive Director of the Board of the Behavioral Health Examiners to serve as the Executive Director of the Massage Therapy Board.

25.  Creates the Committee on Executive Director Selection and Retention and outlines responsibilities and duties.

26.  Removes the Massage Therapy Study Committee.

27.  Establishes reporting requirements.

28.  Contains a purpose clause.

Arizona Criminal Justice Commission (ACJC)

29.  Continues, retroactive to July 1, 2025, ACJC for four years, until July 1, 2029.

30.  Repeals ACJC on January 1, 2030.

31.  Modifies the membership structure of ACJC.

32.  Requires ACJC to meet four times, rather than only once, annually.

33.  Mandates that each ACJC member must attend at least three meetings; if a member does not attend at least three meetings, then his position is deemed vacant by operation of law.

34.  Repeals the statute designating ACJC as the central collection point for criminal justice data collection and authorizing it to collect the same from government agencies.

35.  Mandates that ACJC be subject to review by the Auditor General during its next sunset review. 

36.  Stipulates that existing members of ACJC may continue to serve on ACJC until the normal expiration of their terms.

37.  Contains a purpose clause.

Board of Executive Clemency (BEC)

38.  Continues, retroactive to July 1, 2025, the BEC for 5 years, until July 1, 2030.

39.  Repeals the BEC on January 1, 2031.

Property Tax Oversight Committee (PTOC)

40.  Continues, retroactive to July 1, 2025, the PTOC for 8 years, until July 1, 2033.

41.  Repeals the PTOC on January 1, 2034.

42.  Contains a purpose clause.

School Facilities Oversight Board (SFOB)

43.  Continues, retroactive to July 1, 2025, SFOB for five years, until July 1, 2030.

44.  Repeals SFOB, the Division of School Facilities (Division) and related statutes on January 1, 2031, only if:

a)   SFOB has no outstanding state school facilities revenue bonds, state school improvement revenue bonds and lease-to-own transactions; or

b)   the Legislature has otherwise provided for paying or retiring any outstanding state school facilities revenue bonds, state school improvement revenue bonds and lease-to-own transactions.

45.  Provides that if neither of these conditions has occurred by January 1, 2031, SFOB, the Division and related statutes are repealed 30 days after the retirement of all revenue bonds and outstanding lease-to-own transactions.

46.  Instructs the SFOB director to require each employee to disclose in writing to SFOB at least annually any interest the employee has in any contract, sale, purchase, service or other transaction of SFOB, the Division or a school district.

47.  Directs SFOB to determine whether an interest disclosed by an employee is a substantial interest and to maintain a record of all identified substantial interests.

48.  Prohibits a city or town from assessing or collecting development fees for streets and water sewer utility functions for developments funded in whole or in part from the New School Facilities (NSF) Fund.

49.  States the Legislature intends that SFOB provide only one estimate of projected enrollment, and the associated costs, to the Legislature for the purposes of the NSF Fund.

50.  Contains a purpose statement.

Arizona Exposition and State Fair Board (AESFB)

51.  Continues, retroactive to July 1, 2025, AESFB for 8 years, until July 1, 2033.

52.  Repeals the AESFB on January 1, 2034.

53.  Contains a purpose clause.
