The House Engrossed version of HB 2233 applies Registrar of Contractors licensing requirements to an elevator contractor.

The Senate adopted a strike-everything amendment that does the following:

Overview

Requires the Arizona Corporation Commission (Commission) to take a public vote on an issue before advocating for or against legislation, regulation or rules and authorizes the Attorney General to investigate noncompliance.

History

The Arizona Corporation Commission has the power to prescribe just and reasonable rates and charges for services provided by public service corporations within the state. The Commission may prescribe rules, regulations and orders which govern how public service corporations transact their business. The Commission also regulates the sale of securities and investment advice in Arizona, registers corporations and limited liability companies and enforces regulations to ensure railroad and pipeline safety (Article XV § 3, Const. of Ariz., Arizona Corporation Commission).

Provisions

1.   Prohibits the Commission, its staff and lobbyists from advocating for or against federal or state legislation, regulations or rules before the Commission does the following:

a)   takes a majority vote at a publicly noticed meeting; and

b)   publishes the Commission's position on their website and a legislative information system or comparable system used by the Legislature or the Governor's Regulatory Review Council. (Sec. 1)

2.   Allows the Attorney General to investigate whether the commission has violated these requirements upon the request of one or more members of the Legislature. (Sec. 1)

3.   States if the Commission or a Commissioner is in violation of the measure, they are subject to a civil penalty of $500 for each instance of noncompliance. (Sec. 1)

4.   Specifies the measure does not prevent a Commissioner from representing their own position as an individual. (Sec. 1)
