SENATE CONCURRENT RESOLUTION 1004

A Concurrent Resolution

proposing an amendment to the Constitution of Arizona; amending article IX, Constitution of Arizona, by adding section 26; relating to taxation.

Be it resolved by the Senate of the State of Arizona, the House of Representatives concurring:

1. Article IX, Constitution of Arizona, is proposed to be amended by adding section 26 as follows if approved by the voters and on proclamation of the Governor:

26. Vehicle miles traveled; taxing, monitoring and limiting prohibited; exception

Section 26. A. This state and any county, city, town, municipal corporation or other political subdivision of this state may not do either of the following:

1. Impose a tax or fee on any person based on the vehicle miles traveled by the person in a motor vehicle.

2. ENACT ANY RULE OR LAW TO MONITOR OR LIMIT THE VEHICLE MILES TRAVELED BY A PERSON IN A MOTOR VEHICLE UNLESS THE RULE OR LAW REQUIRES that THE PERSON VOLUNTARILY consents TO THE monitoring OR LIMITATION.

B. THIS SECTION DOES NOT APPLY TO EITHER OF THE FOLLOWING:

1. AN INTERSTATE AGREEMENT THAT IS ESTABLISHED TO ADMINISTER THE PAYMENT OR REPORTING OF FUEL TAXES OR REGISTRATION FEES FOR COMMERCIAL VEHICLES THAT OPERATE IN MORE THAN ONE STATE.

2. A MOTOR VEHICLE OWNED AND OPERATED BY ANY ENTITY LISTED IN SUBSECTION A OF THIS SECTION.

2. The Secretary of State shall submit this proposition to the voters at the next general election as provided by article XXI, Constitution of Arizona.
