SENATE CONCURRENT RESOLUTION 1031

A CONCURRENT RESOLUTION

Proposing an amendment to the constitution of arizona; amending article XIX, constitution of arizona, as amended by proposition 101, election of november 3, 1992; repealing article XIX, constitution of arizona, as amended by proposition 107, election of november 3, 1992; relating to mines.

Be it resolved by the Senate of the State of Arizona, the House of Representatives concurring:

1. Article XIX, Constitution of Arizona, as amended by Proposition 101, election of November 3, 1992, is proposed to be amended as follows if approved by the voters and on proclamation of the Governor:

ARTICLE XIX. MINES

The office of mine inspector is hereby established.  The legislature shall enact laws so regulating the operation and equipment of all mines in the state as to provide for the health and safety of workers therein and in connection therewith, and fixing the duties of said the office.  Upon approval of such laws by the governor, the governor, with the advice and consent of the senate, shall forthwith appoint a mine inspector, who shall serve until his successor shall have been elected at the first general election thereafter and shall qualify.  Said successor and all subsequent Incumbents of said the office shall be elected at general elections,  and shall serve for a term of four years.  The initial four year four-year term shall be served by the mine inspector elected in the general election held in November, 1994. The mine inspector shall not hold that office for more than two consecutive terms.  This limitation on the number of terms of consecutive service shall apply to terms of office beginning on or after January 1, 2027.  A mine inspector who serves the maximum number of terms, which shall include any part of a term served, shall not serve in that office until out of office for not less than one full term.in the general election held in November, 1994. [The mine inspector shall not hold that office for more than two consecutive terms.  This limitation on the number of terms of consecutive service shall apply to terms of office beginning on or after January 1, 2027.  A mine inspector who serves the maximum number of terms, which shall include any part of a term served, shall not serve in that office until out of office for not less than one full term.]

2. Article XIX, Constitution of Arizona, is proposed to be repealed as follows if approved by the voters and on proclamation of the Governor:

Article XIX, Constitution of Arizona, as amended by Proposition 107, election of November 3, 1992, relating to the office of the mine inspector, is repealed.

3. The Secretary of State shall submit this proposition to the voters at the next general election as provided by article XXI, Constitution of Arizona.
