amending title 41, chapter 12, article 2, Arizona Revised Statutes, by adding section 41-1735; appropriating monies; relating to the department of public safety.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 41, chapter 12, article 2, Arizona Revised Statutes, is amended by adding section 41-1735, to read:

START_STATUTE41-1735. Law enforcement personnel grant program; reimbursement; replacement officers; definitions

A. The law enforcement personnel grant program is established to reimburse law enforcement agencies in this state that have law enforcement officers that participate in an immigration training program established under 8 united states code section 1357(g), including a program that delegates immigration authority, duties and enforcement to law enforcement agencies in this state. The department shall administer the grant program. A Law ENFORCEMENT agency in this state shall submit an application on a form prescribed by the department.

B. Reimbursement made pursuant to this section shall cover the salary of either or both of the following law enforcement officers for not more than one month related to the immigration training program pursuant to subsection A of this section:

1. the law enforcement officer participating in the immigration training program if the law enforcement officer's salary is not reimbursed by the United States government.

2. any law enforcement officer needed to temporarily replace the law enforcement officer participating in the immigration training program.

C. For the purposes of this section:

1. "Law enforcement agency" means a municipal police agency or a county sheriff's department.

2. "Law enforcement officer" means an officer in the employment of a law enforcement agency. END_STATUTE

Sec. 2. Appropriation; department of public safety; exemption

A. The sum of $2,000,000 is appropriated from the state general fund in fiscal year 2025-2026 to the department of public safety for the law enforcement personnel grant program established by section 41-1735, Arizona Revised Statutes, as added by this act.

B. The appropriation made in subsection A of this section is exempt from the provisions of section 35-190, Arizona Revised Statutes, relating to lapsing of appropriations.
