amending title 13, chapter 31, Arizona Revised Statutes, by adding section 13-3123; relating to weapons.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 13, chapter 31, Arizona Revised Statutes, is amended by adding section 13-3123, to read:

START_STATUTE13-3123. Armed repeat offenders; classification; definition

A. a person is an armed repeat offender if the person commits misconduct involving weapons pursuant to section 13-3102, subsection A, PARAGRAPH 4 and the person both:

1. has been convicted of three or more historical prior felony convictions on three separate dates.

2. Has served prior prison time.

b. A violation of this section is a class 2 felony.

c. for purposes of this section, "historical prior felony conviction" includes Any offense committed outside this state that if committed in this state would constitute a class 1, 2, 3 or 4 felony. END_STATUTE
