An Act

 

amending title 9, chapter 7, article 1, Arizona Revised Statutes, by adding section 9-810.02; relating to municipal building codes.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 9, chapter 7, article 1, Arizona Revised Statutes, is amended by adding section 9-810.02, to read:

START_STATUTE9-810.02. Municipal building codes; residential buildings; building materials; prohibition; definition

A. A municipality may not adopt or enforce any code, ordinance, standard, stipulation or other legal requirement that does either of the following:

1. Prohibits or limits, directly or indirectly, using or installing a building product or material in the construction, renovation, maintenance or other alteration of a residential building if the building product or material is approved for use by a national model code that applies to the construction, renovation, maintenance or other alteration of the building. 

2. Subjects a prefabricated residential building, material or component to additional or different requirements from other residential buildings except as required by federal law.

B. For the purposes of this section, "prefabricated residential building" means a structure or a portion of a structure that is transportable in one or more sections and designed to be used as a dwelling with or without a permanent foundation when connected to required utilities. END_STATUTE
