Purpose
Directs the Arizona Department of Corrections, Rehabilitation and Reentry (ADCRR) to conduct a comprehensive study that determines whether the Marana Prison site could be converted into and used as a transitional facility for inmates who are set to be released within 60 days of the inmate's scheduled release date.
Background
The Director of
ADCRR (Director) may authorize an eligible inmate who is within 90 days of the
inmate's earliest release date to participate in a community reentry work
program. The Director must adopt rules to implement the community reentry work
program, including eligibility criteria for the selection of inmates. To be
eligible, at a minimum, the inmate must: 1) not have been convicted at any time
of any of offense of kidnapping, sexual offenses, arson, a violent crime or a
dangerous crime against children; 2) not currently be serving a sentence for a
domestic violence offense; 3) be classified by ADCRR as a low risk to the
community; 4) not have any felony detainers or U.S. immigration and customs
enforcement detainers; 5) not have previously escaped or attempted to escape
from a secure or nonsecure jail or prison facility or environment; 6) have made
satisfactory progress on the inmate's individualized corrections plan as
determined by ADCRR; 7) have maintained civil behavior while incarcerated as
determined by ADCRR;
8) be current on any restitution payments ordered by the court; and 9) have a
need and ability to benefit from a community reentry work program as determined
by ADCRR (A.R.S.
§ 41-1604.18).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Directs ADCRR to conduct a comprehensive study that:
a) determines whether the Marana Prison site could be converted into and used as a transitional facility for inmates who are set to be released within 60 days of the inmate's scheduled release date;
b) evaluates the feasibility of using the Marana Prison site to establish a program that provides inmates with transitional skills and that connects inmates to other transitional services; and
c) analyzes and accounts for any current resources that may be used for the purpose of establishing the transitional facility and program and determines what additional Arizona resources are necessary for the transitional facility and program.
2. Requires ADCRR, by June 1, 2025, to submit a report containing the findings of the study and any recommendations to the Governor, the President of the Senate and the Speaker of the House of Representatives.
3. Repeals the prison site study requirement on July 1, 2025.
4. Becomes effective on the general effective date.
