Purpose
Requires an Arizona public university that seeks to transfer monies to a university-recognized organization or club to provide each student with a reasonable opportunity to select student clubs or organizations that may not receive the student's pro rata share of the monies.
Background
The Arizona Board of Regents (ABOR) fixes Arizona public university tuition and fees, differentiating between institutions and between residents, nonresidents, undergraduate students, graduate students and students from foreign countries. An Arizona public university may not transfer any portion of the tuition and fees collected from students or use any university student billing process to collect monies on behalf of an organization that is not under ABOR's jurisdiction or recognized as a university student organization. An Arizona public university may establish a student government and university-recognized student organizations and clubs and provide support for such student groups from tuition and fees (A.R.S. §§ 15-1626 and 15-1626.01).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Requires
an Arizona public university that seeks to transfer monies from any source,
excluding private donations that are designated for a specific student
organization or club, to a
university-recognized student organization or club to:
a) provide each student who is charged tuition and fees with a reasonable opportunity to select one or more student organizations or clubs that may not receive the student's pro rata share of the monies; and
b) transfer reduced pro rata shares of the monies consistent with student selections.
2. Specifies that, if a student does not select one or more student organizations or clubs to withhold monies from, the Arizona public university must transfer the student's pro rata share of monies as otherwise provided by law.
3. Makes technical changes.
4. Becomes effective on the general effective date.
