Overview
Establishes the Solar Panel Disposal Study Committee (Study Committee).
History
The Arizona Department of Environmental Quality (ADEQ) is responsible for administering the state's environmental laws and any federal programs delegated to the state to prevent air, water and land pollution and ensure their proper cleanup.
ADEQ is also required to promote and recommend methods to recover, recycle, reuse and dispose of solid wastes consistent with sound health, scenic and environmental quality policies (A.R.S. § 49-104).
Currently, there is no law or regulation that specifically regulate the disposal of solar panels. However, under the federal Resource Conservation and Recovery Act, certain solar panels can be considered "hazardous waste." Pursuant to this act, the Environmental Protection Agency has developed regulations to safely manage hazardous waste from when it is generated to when it is disposed (42 U.S.C. §6901 et seq.) (40 Code of Federal Regulations Section 261.3).
A solar energy device is defined as a system or series of mechanisms that is designed primarily to provide heating, cooling, electrical power, solar daylighting or any combination of the foregoing by means of collecting and transferring solar generated energy into such uses either by active or passive means or produce mechanical power (A.R.S. § 40-1761).
Provisions
1. Establishes the Study Committee to consist of members appointed by the Legislature to study the abandonment, recycling and disposal of solar panels.
2. Specifies that a majority of the committee constitutes a quorum.
3. Authorizes the Study Committee to:
a) request the services, equipment, documents, personnel and facilities from state agencies or political subdivisions, as possible without cost to the committee; and
b) utilize legislative staff for administrative and operational services.
4. Requires the Study Committee to submit a report of findings and recommendations to the Governor, President of the Senate and Speaker of the House of Representatives by December 31, 2024 and provide a copy of the report to the Secretary of State.
5. Repeals the Study Committee on October 1, 2025.
