"Section 1. Title 28, chapter 2, article 2, Arizona Revised Statutes, is amended by adding section 28-340, to read:
28-340. Public resources; greenhouse gas emission reduction prohibition; definition
A. Pursuant to section 49-191, the department may not spend any public resources to adopt or enforce a plan or strategy to reduce greenhouse gas emissions.
B. FOr the purposes of this section, "greenhouse gas" has the same meaning prescribed in section 49-191."

Between lines 9 and 10, insert:
"Sec. 4. Section 49-191, Arizona Revised Statutes, is amended to read:
49-191. Greenhouse gas programs; definition
A. Notwithstanding any other law, the department of transportation established under title 28 or a state agency established under this title or title 41 shall not adopt or enforce a state or regional program to regulate the emission of greenhouse gas for the purposes of addressing changes in atmospheric temperature without express legislative authorization.
B. For the purposes of this section, "greenhouse gas" means carbon dioxide, methane, nitrous oxide, sulfur hexafluoride, hydrofluorocarbon or perfluorocarbon."
