An Act

 

appropriating monies to the department of transportation.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Appropriations; department of transportation; freeway interchange; Interstate 10; Jackrabbit Trail; intent; reversion; exemption

A. In addition to any other appropriation made in fiscal year 2022-2023, the sum of $5,000,000 is appropriated from the state general fund in fiscal year 2022-2023 to the department of transportation to design a freeway interchange on Interstate 10 at Jackrabbit Trail.

B. The sum of $30,000,000 in fiscal year 2023-2024 and $35,000,000 in fiscal year 2024-2025 are appropriated from the state general fund to the department of transportation to construct a freeway interchange on Interstate 10 at Jackrabbit Trail, including:

1. All traffic control devices for on-ramps and off-ramps related to the freeway interchange.

2. All related and necessary traffic control devices to the north and south of the freeway interchange at Jackrabbit Trail and McDowell Road.

C. The legislature intends that the department of transportation use any federal monies available for the projects described in this section to supplement the monies appropriated to the department of transportation by this section. If the department of transportation receives federal monies for a project described in this section, the department of transportation shall revert to the state general fund an amount equal to the amount of federal monies received but not more than the total amount appropriated by this section.

D. The legislature intends that the design and construction of the freeway interchange at Jackrabbit Trail be accelerated.  The department of transportation shall use the construction-manager-at-risk project delivery method prescribed in section 34-602, subsection A, paragraph 2, Arizona Revised Statutes, to complete this project.

E. The appropriations made in subsection A and B of this section are exempt from the provisions of section 35-190, Arizona Revised Statutes, relating to lapsing of appropriations.
