FACT SHEET FOR h.b. 2293

 

liquor; purchase; identification

Purpose

Adds a valid unexpired border crossing card issued by the U.S. government as an acceptable form of identification to determine whether a person is of legal drinking age.

Background

The Department of Liquor Licenses and Control (DLLC), which consists of the State Liquor Board and the Office of the Director of DLLC, regulates the manufacture, distribution and sale of liquor in Arizona through the issuance of a series of licenses and investigation of licensee compliance with liquor laws. A separate license is required for each specific type of business and is issued only after: 1) a satisfactory showing of the capability, qualifications and reliability of the applicant; and 2) that the public convenience requires and that the best interest of the community will be substantially served by the issuance (A.R.S. §§ 4-111 and 4-203).

            Current statute lists the following as acceptable forms of identification to determine whether a person is of legal drinking age: 1) an unexpired Arizona driver license; 2) an unexpired driver license issued by another state, a U.S. territory or Canada; 3) an unexpired Arizona nonoperating driver license; 4) another form of identification issue by another state, a U.S. territory or Canada, if the license is substantially equivalent to an Arizona nonoperating identification license; 5) an unexpired armed forces identification; and 6) a valid unexpired passport or a valid unexpired resident alien card (A.R.S. § 4-241).

            A border crossing card is also a B1/B2 visitor's visa that is issued by the U.S. Department of State only to applicants who are citizens and residents of Mexico. Applicants must meet the eligibility requirements for a B1/B2 visa and demonstrate that they have ties to Mexico that would compel them to return after a temporary stay in the United States (U.S. Department of State).

               There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Adds, as an acceptable form of identification for a licensee, a licensee's employee or any other person to determine whether a person is of legal drinking age, a valid unexpired border crossing card that is issued by the U.S. government that contains the person's photograph and date of birth. 

2.   Makes technical changes.

3.   Becomes effective on the general effective date.
