electronic certificates of title
Purpose
Prohibits the Director of the Arizona Department of Transportation (ADOT) from prohibiting an authorized third party from using an electronic certificates of title system to print an electronic certificate of title or a registration card.
Background
The Director of ADOT (Director) may establish a system to require the recording of certificate of title information for newly issued, transferred and corrected certificates of title through electronic media in a cost-effective manner in lieu of paper documents. When establishing the system, the Director must: 1) establish procedures for issuing and maintaining an electronic certificate of title system that is applicable to all certificate of title transactions performed in Arizona; and 2) develop methods to electronically share information related to applications for certificates of title with law enforcement agencies and licensed entities (A.R.S. § 28-2064).
An authorized third party is an entity that has executed a written agreement and is authorized by ADOT to perform limited or specific functions but is not authorized by ADOT to function as an authorized third party electronic service provider (A.R.S. § 28-5100).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Prohibits the Director from prohibiting an authorized third party from printing an electronic certificate of title or a registration card in an electronic certificates of title system.
2. Makes conforming changes.
3. Becomes effective on the general effective date.
Amendments Adopted by Committee
