Purpose

Requires, for a restriction on highway use to be enforceable, a uniform sign designed by the Arizona Department of Transportation (ADOT) to be placed near every ingress and egress, inform the public of the restriction and direct the public to the fastest route to leave the restricted route.

Background

A local authority may prohibit, by ordinance or resolution, the operation of trucks or other commercial vehicles or impose limitations on the weight of vehicles on highways under its jurisdiction. The local authority must place appropriate signs on the highway to designate a prohibition or limitation.

The Director of ADOT (Director) may determine by resolution to impose a restriction on the weight of vehicles on a highway under the Director's jurisdiction. A restriction is effective once signs giving notice of the restriction are erected on the portion of the highway affected by the resolution (A.R.S. § 28-1106).

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Requires a sign giving notice of a highway-use restriction to:

a)   inform the public of the restriction;

b)   be uniform and designed by ADOT;

c)   be placed near every ingress and egress along the designated highway; and

d)   direct the public to the fastest route to leave a restricted route.

2.   Deems a restriction on highway use as unenforceable if the Director or local authority fails to erect and maintain signs, as prescribed.

3.   Becomes effective on the general effective date.

Amendments Adopted by Committee of the Whole

1.   Modifies the requirements for a sign designating a route restriction to be:

a)   uniform and designed by ADOT; and

b)   placed near every ingress and egress, rather than at least every quarter mile, along the designated highway.

2.   Makes technical and conforming changes.
