An Act
appropriating monies to the Arizona commerce authority.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Appropriation; Arizona commerce authority; Arizona infrastructure grant program; exemption
A. The sum of $30,000,000 is appropriated from the state general fund in fiscal year 2023-2024 to the Arizona commerce authority to administer an Arizona infrastructure grant program.
B. The authority may not use more than one percent of the monies appropriated by this section to administer the grant program. The authority shall use the remaining monies appropriated by this section to award grants pursuant to title 41, chapter 24, Arizona Revised Statutes, to nonprofit organizations based in this state that:
1. Are exempt from taxation under section 501(c)(3) of the internal revenue code.
2. Qualify for federal funding pursuant to Public Law 117-169, 136 Stat. 1818.
3. Have demonstrated the availability of resources or private investment from sources other than this state for the purposes of the grant program.
4. Have an operations agreement with a qualified federally registered bank.
C. The grant monies awarded by the authority shall be used for any of the following:
1. Investments authorized by Public Law 117-169, 136 Stat. 1818, including projects in partnership with, and that leverage investment from, the private sector.
2. Projects that assist low-income communities to deploy or to benefit from zero emission technologies.
3. Investments in partnership with counties, cities, towns and special districts within water management areas.
D. The appropriation made in subsection A of this section is exempt from the provisions of section 35-190, Arizona Revised Statutes, relating to lapsing of appropriations.
