AN ACT

 

amending title 16, chapter 4, article 1, Arizona Revised Statutes, by adding section 16-410.01; relating to the conduct of elections.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 16, chapter 4, article 1, Arizona Revised Statutes, is amended by adding section 16-410.01, to read:

START_STATUTE16-410.01. Election observers

Notwithstanding any other law:

1. All election observers must be allowed uniform access to all stages of the election process, beginning with ballot DESIGN through tabulation of the final vote.

2. Election OBSERVERS must BE allowed to document their observations, ask questions of election officials and receive timely answers.

3. All election observers must be allowed to be in proximity to the process closely enough to observe whether the process is being conducted correctly.

4. Election observers may only be ejected for significant concerns on the approval of the inspector and the marshal.  The election observer may notify the political party chairman who may appeal the ejection to the county recorder, whose decision is final. END_STATUTE
