SENATE BILL 1184

 

 

An Act

 

appropriating monies to the Arizona health care cost containment system administration, the department of economic security and the department of child safety.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Supplemental appropriations; Arizona health care cost containment system administration; department of economic security; reports; exemption

A. In addition to any other appropriations made in fiscal year 2021-2022, the following sums are appropriated to the following agencies in fiscal year 2021-2022:

1. The sums of $30,121,100 from the children's health insurance program fund established by section 36-2995, Arizona Revised Statutes, and $1,078,032,800 of expenditure authority are appropriated to the Arizona health care cost containment system administration to implement the American rescue plan act of 2021 home and community-based services spending plan and to adjust funding formula requirements.

2. The sum of $362,700,000 of expenditure authority is appropriated to the department of economic security division of developmental disabilities to implement the American rescue plan act of 2021 home and community-based services spending plan.

B. The Arizona health care cost containment system administration may not use any monies appropriated in subsection A of this section for marketing purposes. Any direct payments or grants provided with the monies appropriated in subsection A of this section shall include a notification to the recipient that the monies are onetime funding.

C. The Arizona health care cost containment system administration shall provide quarterly reports to the joint legislative budget committee, at the same time that the information is provided to the centers for medicare and medicaid services, reflecting any changes to the administration's spending plan for the implementation of the American rescue plan act of 2021.

D. The appropriations made in subsection A of this section are exempt from the provisions of section 35-190, Arizona Revised Statutes, relating to lapsing of appropriations.

Sec. 2. Supplemental appropriation; department of child safety; exemption

A. In addition to any other appropriations made in fiscal year 2021-2022, the sum of $15,100,000 of expenditure authority is appropriated in fiscal year 2021-2022 to the department of child safety operating lump sum line item to continue existing functionality and oversight and to claim available federal monies that will expire and revert back to the federal government.

B. The appropriation made in subsection A of this section is exempt from the provisions of section 35-190, Arizona Revised Statutes, relating to lapsing of appropriations.
