Antifa; domestic terrorist designation

Purpose

Urges the designation of Antifa as a domestic terrorist organization.

Background

Federal statute defines domestic terrorism as activities that: 1) involve acts dangerous to human life that are a violation of the criminal law of the United States or of any state; 2) appear to be intended to intimidate or coerce a population, to influence the policy of the government by intimidation or coercion or to affect the conduct of government by mass destruction, assassination or kidnapping; and 3) occur primarily within the territorial jurisdiction of the United States
(18 U.S.C. § 2331).

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Urges the designation of the following groups and organizations in the United States as domestic terrorist organizations:

a)   those that act under the banner of Antifa;

b)   those that affiliate with Antifa; and

c)   offshoots of Antifa formed by the same people under different names.

2.   Declares that the Legislature:

a)   condemns the violent actions of Antifa groups as unacceptable; and

b)   supports groups and organizations in the United States that voice opinions without using violence or threatening the health, safety, state or well-being of any person, group or law enforcement officer.

3.   Requires the Secretary of State to transmit copies of the resolution to the President of the U.S. Senate, the Speaker of the U.S. House of Representatives and each Member of Congress from the State of Arizona.
