misconduct involving weapons; school grounds
Purpose
Allows an adult to carry a firearm within a means of transportation on school grounds, regardless of whether the firearm is loaded or not.
Background
A person commits misconduct involving weapons by, among other offenses, knowingly possessing a deadly weapon on school grounds. Exceptions include: 1) a firearm that is not loaded and that is carried within a vehicle under the control of an adult, provided that if the adult leaves the vehicle the firearm must not be visible from outside of the locked vehicle; 2) a firearm for use on the school grounds in a program approved by the school; and 3) a firearm carried by a person who possesses a certificate of firearm proficiency and who is authorized to carry a concealed firearm. Possessing a deadly weapon on school grounds when not permitted is classified as a class 1 misdemeanor (A.R.S. § 13-3102).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Removes the requirement that a firearm carried by an adult within a means of transportation on school grounds must be unloaded in order to not be considered a misconduct involving weapons offense.
2. Becomes effective on the general effective date.
