Purpose

Prohibits a state agency, department or division or a political subdivision from registering a person to vote without the person's affirmative request to register to vote.

Background

A county recorder must distribute state mail-in registration forms at locations throughout the county, including government offices, fire stations, public libraries and other locations open to the general public (A.R.S. § 16-131). The Secretary of State must make federal voter registration forms available for distribution through governmental and private entities (A.R.S. § 16-151). All public assistance agencies and disabilities agencies of Arizona must provide the opportunity to register to vote for those persons who apply for benefits or appear at the agency to renew, recertify or change address information. A county recorder may designate additional voter registration volunteers who may provide state mail-in registration forms to persons who wish to register to vote (A.R.S. § 16-140).

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Prohibits an agency, department or division of Arizona or a political subdivision of Arizona or a person acting on behalf of an agency, department or division of Arizona or a political subdivision of Arizona from registering a person to vote without the person's affirmative request to register to vote.

2.   Becomes effective on the general effective date.
