FACT SHEET FOR H.B. 2030

 

state hospital; procurement; overtime

Purpose

            Allows the Director of the Arizona Department of Administration (Director) to authorize a workday for Arizona State Hospital (ASH) employees who are regularly scheduled to work a shift that spans two calendar days and exempts the Department of Health Services (DHS) from procurement code requirements for contracts providing treatment to ASH patients.

Background

             In contrast to the traditional workweek that applies to most employees of the state personnel system, current statute allows the Director to authorize a workday for correctional officers employed by the Arizona Department of Corrections who regularly work a shift that spans two calendar days. Workdays are defined as the day a majority of employee hours are regularly scheduled to be worked for the purpose of recording time entries to be included in a workweek and pay period. If the regularly scheduled hours are equally split between two calendar days, the workday is defined as the day the shift ends. Scheduled shift start and end times may not be adjusted to avoid the payment of overtime (A.R.S. § 23-391).

ASH is a 260-bed facility, operated and regulated by DHS, that provides long-term inpatient psychiatric care to individuals with mental illnesses, personality disorders or emotional conditions who are under a court order to receive treatment (A.R.S. Title 36, Chapter 2, Article 1).

            Procurement means buying, purchasing, renting, leasing or otherwise acquiring any materials, services, construction or construction services and includes all functions that pertain to obtaining any materials, services, construction or construction services, including description of requirements, selection and solicitation of sources, preparation and award of contract and all phases of contract administration (A.R.S. § 41-2503). Current statute states that DHS is exempt from procurement code requirements for contracts for services of physicians at ASH (A.R.S.
§ 41-2501
).

            There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Allows the Director to authorize a workday for ASH employees who are regularly scheduled to work a shift that spans two calendar days, for the purpose of workweek and pay period time entries.

2.   Exempts DHS from procurement code requirements for contracts to provide medically necessary physical health care to individuals under the care of ASH.

3.   Makes technical changes.

4.   Becomes effective on the general effective date.
