Overview

Directs cities, towns and counties (local governments) to create an administrative procedure to grant a zoning ordinance exception for the placement of assisted living homes.

History

An assisted living home is an assisted living facility that provides resident rooms to ten or fewer residents. An assisted living facility is a residential care institution, including an adult foster care home, that provides or contracts to provide supervisory care services, personal care services or directed care services on a continuous basis (A.R.S. § 36-401).

1.   Requires a local government that has a zoning ordinance that restricts the distance between assisted living homes to establish an administrative procedure to grant exceptions as a reasonable accommodation under the federal Fair Housing Act. (Sec. 1, 2)

2.   Directs local governments to provide notice of the administrative procedure for exceptions when a registration or land use application for an assisted living home is filed. (Sec. 1, 2)

3.   Specifies that any ordinance restricting the distance between assisted living homes must be measured on a linear foot basis from lot line to lot line. (Sec. 1, 2)
