Overview

Prevents cities, towns and counties (local governments) from restricting the placement of assisted living homes.

History

An assisted living home is an assisted living facility that provides resident rooms to ten or fewer residents. An assisted living facility is a residential care institution, including an adult foster care home, that provides or contracts to provide supervisory care services, personal care services or directed care services on a continuous basis (A.R.S. § 36-401).

1.   Prohibits a local government from restricting, with a land use regulation or a general or specific plan, the distance between an existing assisted living home and a new assisted living home if all other standards and requirements have been met. (Sec. 1, 2)
