HB 2711: vacation rentals; short-term rentals; restrictions

Overview
Authorizes a municipality with less than 17,000 people to require permits or licenses for vacation rentals and short-term rentals, limit the number of these properties and regulate these properties like transient lodging activities.
History
Municipalities cannot prohibit vacation rentals or short-term rentals but can regulate these properties by:
1) Protecting public health and safety, including rules and regulations for fire and building codes;
2) Adopting and enforcing residential use and zoning ordinances that are applied in the same manner as class three and four properties, which are used for residences;
3) Limiting the use of these rental properties for housing sex offenders, operating a sober living home and being used for illicit or nefarious purposes; and
4) Requiring the owners of such properties to provide their contact information in order to respond to complaints in a timely manner before offering the property for rent.
A municipality can assess civil penalties for violations of its rules and regulations (A.R.S. § 9-500.39).
There are at least 57 municipalities with less than 17,000 in Arizona.
Provisions
1. Authorizes a municipality with less than 17,000 people to:
a) Require the owner of a vacation rental or short-term rental to obtain and maintain a municipal-issued permit or license before going into business;
b) Limit the number of vacation and short-term rentals based on a percentage of total residentially zoned buildings or structures within that municipality; and
c) Regulate vacation rentals or short-term rentals like transient lodging activities. (Sec. 1)
