Summary of the Strike Everything Amendment to HB 2604

Overview

Requires superior courts to issue emergency orders of protection by telephone during the hours the court is closed and increases the effective duration of emergency orders of protection to ninety-six hours. 

History

Counties with a population of 150,000 people or more are required to make a judge, justice of the peace, magistrate or commissioner available during the court's closed hours to issue emergency orders of protection by telephone. Superior courts in counties with a population of fewer than 150,000 people have the option to keep an appropriate individual on-call during the court's off hours for this purpose. Emergency orders of protection are effective until the court's close of business the day following its issuance or seventy-two hours, whichever is longer (A.R.S. § 13-3624). According to the United States Census, nine of Arizona's fifteen counties have a population of fewer than 150,000 people (U.S. Census Bureau).
