Overview

Exempts a person from a penalty for removing, defacing, altering or destroying a motor vehicles manufacturer's serial or identification number during repair or restoration of a motor vehicle manufactured before 1981. 

History

A.R.S. § 28-2531 establishes that a person is guilty of a class 5 felony who:

1)   Intentionally removes a manufacturer serial or identification number from, defaces, alters or destroys a manufacturer serial or identification number or knowingly possesses any removed, defaced, altered or destroyed manufacturer serial or identification number from a motor vehicle; or

2)   Is in possession of a motor vehicle knowingly or having reason to know that the manufacturer's serial or identification number has been removed, defaced, altered or destroyed without the permission of the Arizona Department of Transportation (ADOT).

Neither violation applies to law enforcement officers, employees of the United States, employees of this state or any political subdivision of this state if the violation occurs in the course of their official duties.

Provisions

1.   Exempts a person from a class 5 felony for intentionally removing, defacing, altering or destroying a motor vehicles manufacturer serial or identification number if that person removed and reinstalled the manufacturer's serial or identification number from a motor vehicle manufactured before 1981 if the removal was reasonably necessary for the repair or restoration of the vehicle unless the person knows or has reason to know the vehicle is stolen.
