HB 2202: industrial commission; fee schedule; notice

Overview
An emergency measure that provides requirements the Industrial Commission of Arizona (ICA) must undertake prior to adopting the schedule of fees for physicians and prescription medicines.
History
The ICA
establishes a schedule of fees to be charged by physicians, physical therapists
or occupational therapists attending to injured employees and for prescription
medicines required to treat an injured employee. The ICA is required to annually
review the fees (A.R.S. § 23-908).
Provisions
1. Requires the ICA, prior to taking final action on the schedule of fees relating to attending injured employees and prescription medicines required for treatment, to:
a) Prominently post on its publicly accessible website the proposed schedule of fees at least 90 days before conducting a public hearing on that proposed schedule of fees;
b) Hold at least one meeting that all interested parties may jointly attend after posting the proposed schedule of fees, but before conducting the hearing on the proposed schedule of fees; and
c) At least 14 business days in advance, prominently post on its website the final proposed schedule of fees to be acted on for adoption. (Sec. 1)
2. Makes technical changes. (Sec. 1)
3. Contains an emergency clause. (Sec. 2)
Amendments
Committee on Commerce
1. Adds the requirements do not apply during a public health emergency.
2. Reduces the amount of time the ICA has to post the proposed schedule of fees from 90 days to 30 days.
3. Reduces the amount of time the ICA has to post the final proposed schedule of fees from 14 days to 7 days.
