HB 2201: counties; committed youth contributions; repeal

Overview

Repeals the requirement that Maricopa and Pima counties pay a committed youth confinement cost sharing fee to the Arizona Department of Juvenile Corrections (ADJC).

History

ADJC assesses an annual committed youth confinement cost sharing fee to counties with a population over 500,000. Counties must pay the fee within 30 days of the request from ADJC or have the assessed fee withheld by the State Treasurer. County contributions to ADJC may come from any fund source available to the county (A.R.S. § 41-2832).

All cost sharing monies collected by ADJC from counties are deposited into the ADJC Local Cost Sharing Fund (Fund; A.R.S. § 41-2833).

The committed youth confinement cost sharing fee was first established by Laws 2015, Ch. 17, the FY 2016 Criminal Justice Budget Reconciliation Bill (BRB), which applied the fee to all counties regardless of population. Laws 2019, Ch. 268, the FY 2020 Criminal Justice BRB, established the current population threshold of 500,000. According to the 2020 Census, only Maricopa County and Pima County have a population over 500,000.

2.   Transfers all unexpended monies in the Fund to the state General Fund (GF). (Sec. 1)

3.   Directs the Arizona Department of Administration to distribute the monies transferred to the GF from the Fund to each county in a share proportional to its population. (Sec. 1)
