Overview
Requires applicants for licensure related to the production, installation and sale of manufactured homes, mobile homes, and factory-built buildings to obtain a valid fingerprint clearance card rather than undergoing a background analysis. Modifies the maximum civil penalty for a violation of laws, rules or regulations.
History
The Arizona Department of Housing (ADOH) annually administers various housing and other federal and state programs. The U.S. Department of Housing and Urban Development (HUD) designated ADOH as its state administrative agency for manufactured housing and related Arizona industries; the Manufactured Housing and Building Division within HUD maintains standards of safety for all manufactured homes, factory-built buildings and accessory structures. ADOH licenses manufacturers, dealers, brokers, salespersons and installers of manufactured homes, mobile homes, and factory-built buildings.
Laws 1998, Chapter 270 standardized state and federal criminal history records checks conducted by the Departments of Economic Security, Education, Health Services and Juvenile Corrections and the Arizona Supreme Court into a single process with the use of fingerprint clearance cards. Arizona statutes require a fingerprint clearance card for several types of professional licensure, certification and state jobs, mainly those that involve working with children or vulnerable adults. The Department of Public Safety (DPS) must deny a card if an applicant is subject to registration as a sex offender, has been convicted of or is awaiting trial for certain crimes listed in statute or if DPS cannot determine the outcome of an arrest for these crimes within 30 business days after receiving the criminal records.
Current applicants for licensure related to manufactured homes, mobile homes and factory-built buildings must submit fingerprints to ADOH and undergo a background analysis. ADOH reviews the person's background to determine whether to issue a license. ADOH also determines whether the person is of good moral character and reputation based on the person's background (A.R.S. § 41-4025).
Provisions
1. Requires applicants for licensure related to the production, installation and sale of manufactured homes, mobile homes, and factory-built buildings to obtain a fingerprint clearance card rather than for ADOH to conduct a background analysis. (Sec. 6)
2. Outlines the process when ADOH determines a fingerprint clearance card is invalid and the applicant fails to submit a new one within 10 days. (Sec. 6)
3. Removes the terms residential and residential single family from the description of a factory-built building throughout sections of law. (Sec. 4, 6, 8)
4. Removes the $1,000 cap on violations of laws, rules or regulations and instead stipulates a maximum civil and administrative penalty as determined annually by HUD. (Sec. 9)

Makes technical and conforming changes.
