AMENDING TITLE 12, CHAPTER 7, Arizona Revised Statutes, BY ADDING ARTICLE 6.2; RELATING TO CIVIL PROCEEDINGS.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 12, chapter 7, Arizona Revised Statutes, is amended by adding article 6.2, to read:

ARTICLE 6.2. CHALLENGES TO THE CONSTITUTIONALITY,

LEGALITY OR APPLICATION OF A LAW

START_STATUTE12-922. Prohibited consent decree

A. In any state court proceeding in which the constitutionality, legality or application of any provision of title 16 is challenged and a government entity is named as the defendant, the court may not approve or sign a consent decree.

B. In any federal court proceeding in which the constitutionality, legality or application of any provision of title 16 is challenged, this state and any party representing this state may not enter into or sign a consent decree. END_STATUTE
