FLOOR AMENDMENT EXPLANATION

 

1.   Removes the $150,000,000 appropriation from the state GF in FY 2023 to the Border Security Fund (Fund).

2.   Requires the State Treasurer to distribute $335,000,000 in TPT revenues to the Fund.

3.   Requires DEMA to use the monies to construct and maintain a physical border fence and purchase and install border security technologies.

4.   Requires DEMA to report to JLBC on the use of existing infrastructure and the use of the monies.

5.   Declares the Legislature's intent is the TPT distribution does not impact cities, towns and counties portion.

6.   Makes technical and conforming changes.

On or before June 30, 2023, the department of emergency and military affairs shall report to the joint legislative budget committee regarding the use of existing infrastructure and fence materials for the construction of the physical border fence.  Within thirty days after the end of each calendar quarter until the monies appropriated by this section are fully expended, the department of emergency and military affairs, in consultation with the Arizona department of homeland security and the department of public safety, shall report to the joint legislative budget committee regarding the use of monies.

C. The legislature intends that the distributions made in subsection A of this section not impact the portion of transaction privilege tax revenues that cities, towns and counties in this state receive pursuant to section 42-5029, subsection D, Arizona Revised Statutes."
