FLOOR AMENDMENT EXPLANATION

 

1.   Establishes, subject to approval by the Centers for Medicare and Medicaid Services (CMS), the Arizona Health Care Cost Containment System (AHCCCS) Recovery Support and Accountability Program (Program) to incentivize providers to monitor and support members and increase successful recovery.

2.   Incentivizes providers, rather than requires, to implement transitional supports for members who recently graduated from a treatment program, including the use of random semimonthly DNA-matched drug testing.

3.   Removes the requirement that AHCCCS report the number of graduated members that are enrolled in school or job skills training as well as the number of members who own a home or who live with a friend or family member.

4.   Requires the AHCCCS report to include the number of graduated members that are identified as homeless or are in supportive sober living.

5.   Requires, by October 1, 2025, AHCCCS to notify the Director of Legislative Council in writing of either:

a)   the date that CMS approves the request to implement the Program; or

b) the denial of the request.

6.   Conditions the enactment of this legislation on approval by CMS, no later than October 1, 2025.

Section 36-2907.03, Arizona Revised Statutes, as added by this act, does not become effective unless on or before October 1, 2025 the Arizona health care cost containment system administration receives approval from the centers for medicare and medicaid services to implement the recovery support and accountability program.

B. The Arizona health care cost containment system administration shall notify the director of the Arizona legislative council in writing on or before October 1, 2025 either:

1. Of the date on which the condition was met.

2. That the condition was not met."
