AMENDMENT EXPLANATION
1.
Prohibits the Water Infrastructure Finance Authority (WIFA)
from providing funds to a city or town to:
a) condemn
or acquire through eminent domain any assets of a public service corporation
regulated by the Arizona Corporation Commission (ACC); or
b)
refinance
any financing arrangement used by a city or town to condemn or acquire through
eminent domain any assets of a public service corporation regulated by the ACC.
2.
Allows, during FY 2023 through 2027, a WIFA financial
assistance loan repayment agreement that uses Infrastructure Investment and
Jobs Act funding to be entered into without an election by:
a) a
city, town or county, regardless of population; and
b)
a
sanitary district that contains fewer than 50,000 people.
3.
Stipulates that qualifying political subdivisions may enter
into a WIFA agreement using Infrastructure Investment and Jobs Act funding
without an election even if the subdivision must provide matching monies for
the funding.

A. Notwithstanding
sections 9-571, 11-671 and 48-2011.01, during fiscal years 2022-2023, 2023-2024,
2024-2025, 2025-2026 and 2026-2027, the following political SUBDIVISIONS may
enter into a financial assistance loan repayment agreement with the authority
without submitting the question of entering and performing the financial
assistance loan repayment agreement to the qualified electors of the political
subdivision if the agreement is financed with funding made available to the
authority under the Infrastructure Investment and Jobs Act, Division J, title
VI (P.L. 117-58).

3. A
