PROPOSED

SENATE AMENDMENTS TO S.C.R. 1006

Strike everything after the resolving clause and insert:

"1. Article IV, part 2, section 3, Constitution of Arizona, is proposed to be amended as follows if approved by the voters and on proclamation of the Governor:

START_STATUTE3. Sessions of legislature; special sessions; limitation of subjects for consideration; presidential electors

Section 3. A. The sessions of the legislature shall be held annually at the capitol of the state and shall commence on the second Monday of January of each year. The governor may call a special session, whenever in his the governor's judgment it is advisable. In calling a special session, the governor shall specify the subjects to be considered, and at such special session no laws shall be enacted except such as relate to the subjects mentioned in the call.

b. The legislature shall hold a special session at the state capitol commencing on the Monday following the date designated for the election of the president and vice president of the United States.  The purpose of the SPECIAL session is to review or investigate the results of the election in this state, as needed, before certifying the results of the selection of PRESIDENTIAL electors.  The legislature has sole authority to appoint the presidential electors who will cast this state's votes in the electoral college and shall exercise that authority without interference and consistent with Article II, section 1 of the CONSTITUTION of the United States.  The speaker of the house of representatives and the president of the senate shall jointly certify to the Governor the names of the appointed presidential electors, and the governor shall submit those names to the president of the United States senate.END_STATUTE

2. Article V, section 10, Constitution of Arizona, is proposed to be amended as follows if approved by the voters and on proclamation of the Governor:

START_STATUTE10. Canvass of election returns for state officers; certificates of election

Section 10. Except as otherwise provided for presidential electors, the returns of the election for all state officers shall be canvassed, and certificates of election issued by the secretary of state, in such manner as may be provided by law. END_STATUTE

3. The Secretary of State shall submit this proposition to the voters at the next general election as provided by article XXI, Constitution of Arizona."
