FLOOR AMENDMENT EXPLANATION

 

Prohibits, notwithstanding any other law, the state, a city, town, county, school district or other public body that conducts or administers an election audit from receiving or expending private monies for conducting or administering an election audit.

 

Requires a governmental body that is supervising or conducting an election audit that was initiated before July 1, 2021, to file weekly reports with the Secretary of State’s office that includes:

(1) the name, address and occupation of a person or entity that contributes monies, goods or services to an entity or person that conducts, participates or assists with the election audit,

(2) the name, address and occupation of the recipient of monies, goods or services contributed, and

(3) the dollar amount or value of any monies, goods or services contributed.

 

Requires a two-thirds vote of both houses of the legislature for the issuance of a subpoena that compels the attendance of persons or production of materials or equipment for an election audit.

 

Contains a retroactivity clause.

"Sec. 37. Title 16, chapter 4, article 1, Arizona Revised Statutes, is amended by adding section 16-407.03, to read:

START_STATUTE16-407.03. Election audit; private monies prohibited; reports

A. Notwithstanding any other law, this state and a city, town, county, school district or other public body that conducts or administers an election audit may not receive or expend private monies for preparing for, administering or conducting an election audit.

B. For any election audit initiated before July 1, 2021, the governmental body that is supervising or conducting the audit shall file a weekly public report with the secretary of state that provides the following information:

1. The name, address and occupation of every person or entity that CONTRIBUTES monies, goods or services to any entity or person that conducts, participates or assists in conducting the audit.

2. The dollar amount or value of any monies, goods or services contributed.

3. the name, address and occupation of the RECIPIENT of any monies, goods or services contributed.END_STATUTE

Sec. 38. Section 41-1151, Arizona Revised Statutes, is amended to read:

START_STATUTE41-1151. Issuance and service of legislative subpoena

A. A subpoena may be issued by the presiding officer of either house or the chairman of any committee before whom the attendance of a witness is desired. The subpoena is sufficient if it states whether the proceeding is before the senate, house of representatives or a committee, is addressed to the witness, requires the attendance of the witness at a certain time and place, and is signed by either presiding officer or a committee chairman. The subpoena may be served and returned in like manner as civil process.

B. For any subpoena to compel attendance of persons or production of materials or equipment for an audit of an election, the subpoena may only be issued on a two-thirds vote of both houses of the legislature.END_STATUTE

Sec. 39. Retroactivity

Section 16-407.03, Arizona Revised Statutes, as added by this act, and section 41-1151, Arizona Revised Statutes, as amended by this act, apply retroactively to from and after January 1, 2021."
