AN ACT

amending title 16, chapter 4, article 12, Arizona Revised Statutes, by adding section 16-661.01; relating to recounts.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 16, chapter 4, article 12, Arizona Revised Statutes, is amended by adding section 16-661.01, to read:

START_STATUTE16-661.01. Joint legislative audit committee; recount or audit order

Notwithstanding section 16-661, on a majority vote of its members, the joint legislative audit committee may order an audit or a recount of a legislative or statewide election, INCLUDING for presidential electors and congressional offices. On receipt of a certified copy of the joint legislative audit COMMITTEE'S order for a recount, the secretary OF state shall certify to the superior court the facts requiring the recount, and the recount shall proceed as otherwise prescribed by this article. On receipt of a certified copy of the joint legislative audit committee's order for an audit, the custodian of the items requested in the audit shall make those items available to the joint legislative audit committee.
