AN ACT

 

Amending Title 41, chapter 10, article 1, Arizona Revised Statutes, by adding section 41-1509; appropriating monies; relating to the Arizona commerce authority.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 41, chapter 10, article 1, Arizona Revised Statutes, is amended by adding section 41-1509, to read:

START_STATUTE41-1509.  Arizona battery storage technology improvement grant program; advisory council; program termination

A.  The Arizona battery storage technology improvement grant program is established to increase renewable energy capability in this state.  The authority shall administer the grant program using monies appropriated by the legislature for this purpose.

B.  The authority shall:

1.  Promote the improvement of battery technology and its implementation in this state.

2.  Considering the advice of the battery storage technology improvement advisory council, use the program monies to provide grants to political subdivisions of this state, nonprofit organizations and private enterprise for research, demonstration projects or market development for improved battery storage technology and its implementation in this state.  The authority may not use more than five percent of the monies to administer the grant program.

C.  The chief executive officer shall appoint a battery storage technology improvement advisory council that includes at least the following members:

1.  Two persons who work in an academic capacity and who specialize in a field related to battery technology and use.

2.  Two representatives of political subdivisions in this state that provide electricity.

3.  Two representatives of private power utilities.

4.  Two representatives of the residential distributed power generation industry.

5.  two representatives of the electric vehicle industry.

D.  The advisory council shall advise the authority on:

1.  The criteria for distributing program grants.

2.  Efficiently promoting battery technology improvement and its implementation in this state.

E.  The program established by this section ends on June 30, 2031 pursuant to section 41‑3102. END_STATUTE

Sec. 2.  Appropriation; Arizona commerce authority; Arizona battery storage technology improvement grant program; exemption

A.  The sum of $5,000,000 is appropriated from the state general fund in fiscal year 2021-2022 to the Arizona commerce authority to provide grants through the Arizona battery storage technology improvement grant program established by section 41‑1509, Arizona Revised Statutes, as added by this act, to increase renewable energy capability in this state.

B.  The appropriation made in subsection A of this section is exempt from the provisions of section 35‑190, Arizona Revised Statutes, relating to lapsing of appropriations, except that any monies remaining unexpended and unencumbered on June 30, 2024 shall revert to the state general fund.
