FACT SHEET FOR H.B. 2758

 

emissions inspection; collectible vehicles; dealers

Purpose

            Exempts collectible vehicles from the vehicle emissions inspection and tampering inspection requirements.

Background

            Prior to annual or biennial vehicle registration, every motor vehicle in Arizona within Area A, in the Phoenix area, or Area B, in the Tucson area, must pass a vehicle emissions inspection for compliance with state ambient air quality standards. The Director of the Arizona Department of Environmental Quality (Director of ADEQ) adopts minimum emissions standards compliant with the Clean Air Act, and statute prescribes methods to comply, based on vehicle class. Statute authorizes the Director of ADEQ to exempt certain vehicles, including collectible vehicles, from vehicle emissions requirements (A.R.S. Title 49, ch 3, art. 5).

            In order to statutorily qualify as a collectible vehicle, the vehicle must be maintained primarily for use in car club activities, exhibitions, parades or other functions of public interest or for a private collection and be used only infrequently for other purposes, have a collectible vehicle or classic automobile insurance coverage that restricts the collectible vehicle mileage or use and requires the owner to have another vehicle for personal use, and must either bear a model year date of original manufacture that is at least 15 years old or be of unique or rare design, of limited production and an object of curiosity (A.R.S. § 49-542).

            There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Provides an exception from the prohibition on a motor vehicle dealer in Area A or Area B from delivering any vehicle to the retail purchaser prior to the vehicle passing statutorily required vehicle inspections, if the vehicle is a collectible vehicle and the retail purchaser obtains collectible vehicle or classic automobile insurance coverage before the vehicle is delivered.
