ARIZONA STATE SENATE

statewide ADA coordinator; appropriation
Purpose
Requires the Governor's Office of Equal Opportunity (GOEO) to hire a full-time statewide Americans with disabilities coordinator. Appropriates $100,000 and one full-time equivalent (FTE) position in from the state General Fund (state GF) in FY 2022 to the Office of the Governor for an Americans with disabilities coordinator.
Background
GOEO: 1) administers Arizona's equal opportunity guidelines; 2) monitors compliance with state agency equal opportunity plans; 3) processes state employee equal opportunity complaints; 4) provides training; 5) offers mediation services for state agencies; and 6) provides information and referrals to local and national resources (GOEO).
The Americans with Disabilities Act (ADA) was enacted in 1990 as a civil rights law that prohibits discrimination against individuals with disabilities in all areas of public life (ADA).
H.B. 2533 appropriates $100,000 and one FTE position from the state GF in FY 2022 to the Office of the Governor.
Provisions
1. Requires GOEO to hire a full-time statewide Americans with disabilities coordinator.
2. Requires the Americans with disabilities coordinator to implement an annual plan to carry out the requirements of the ADA in Arizona.
3. Requires the annual plan to:
a) be community based;
b) promote the coordination of disabilities activities in Arizona;
c) include a component that provides educational opportunities for small businesses;
d) encourage coordination between small businesses and the disability community to better enhance compliance with the ADA in public and private settings; and
e) include specific enforcement of disability accessibility goals and a method for measuring progress towards goal attainment.
4. Appropriates $100,000 and one FTE position from the state GF in FY 2022 to the Office of the Governor for personal services and employee-related expenditures for an Americans with disabilities coordinator.
5. Becomes effective on the general effective date.
