FACT SHEET FOR H.B. 2268

 

schools; total compensation statements

Purpose

Directs a charter school governing body (governing body) and a school district governing board (governing board) to provide each employee with a total compensation statement as outlined.

Background

A governing board prescribes and enforces policies and procedures to govern schools that are consistent with laws or rules prescribed by the State Board of Education. Among its duties, a governing board manages and controls school property, prescribes the curricula and criteria for the promotion and graduation of pupils and uses school monies from the state and county school apportionment to pay salaries of teachers and other employees (A.R.S. § 15-341).

Statute allows a governing board to employ and fix the salaries and benefits of employees as necessary for the succeeding year. The contracts of all certificated employees are required to be in writing and may be transmitted and received in an electronic format. If a contract has not been transmitted to an employee by the end of the current school year, the electronic contract must be submitted to both the certificated employee's school district email and personal email prior to the start of the next school year (A.R.S. § 15-502).

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Directs a governing body and a governing board to provide each charter school and school district employee with a total compensation statement each fiscal year that is categorized by benefit or payment that includes:

a)   base salary and any additional pay;

b)   medical benefits including the value of any employer-paid portions of insurance plan premiums;

c)   retirement benefit plans, including social security;

d)   legally required benefits;

e)   any paid leave;

f) any other payment made to or on behalf of the employee; and

g)   any other benefit provided.

2.   Makes technical changes.

3.   Becomes effective on the general effective date.
