FACT SHEET FOR H.B. 2080

 

agricultural employment relations board; continuation

Purpose

            Continues the Arizona Employment Relations Board (AERB) for eight years.

Background

            The AERB allows agricultural employees to self-organize, bargain directly for themselves, and form and join or assist labor organizations to bargain collectively through representatives of their own free choosing or to engage in lawful concerted activity for the purpose of collective bargaining (A.R.S. § 23-1383). Statute charges agricultural employers with management rights including to 1) manage, control, and conduct his operations; 2) hire, suspend, discharge or transfer employees in accordance with his judgement of their ability; 3) determine the type of equipment or machinery to be used, standards and quality of work, and set wages, hours and conditions of work; 4) work on his own farm in any capacity at any time; and 5) join or refuse to join any labor organization or employer organization (A.R.S. § 23-1384).

            There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Continues, retroactive to July 1, 2021, AERB until July 1, 2029.

2.   Repeals AERB on January 1, 2030.

3.   Continues the AERB for eight years.

4.   Becomes effective on the general effective date, retroactive to July 1, 2021.
