PSPRS; survivor benefits
Purpose
Entitles the surviving spouse of a deceased Corrections Officer Retirement Plan (CORP) member to receive four-fifths of what the deceased member's pension would have been on the date of death if the deceased member had been retired, if the amount is greater than the current entitlement.
Background
Current statute entitles the surviving spouse of a deceased CORP member to receive a surviving spouse's pension if the spouse was married to the member on the date of the member's death. The amount of the surviving spouse's pension is 40 percent of the deceased member's average monthly salary. The surviving spouse must file a written application with CORP in order to receive the survivor benefit. Payment of a surviving spouse's pension commences on the last day of the month following the member's death and the last payment must be made on the last day of the month in which the surviving spouse's death occurs (A.R.S. § 38-888).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Entitles a surviving spouse to receive four-fifths of what the deceased member's pension would have been on the date of death if the deceased member had been retired, if the amount is greater than the current entitlement.
2. Becomes effective on the general effective date.
