FACT SHEET FOR S.B. 1321

 

appropriation; adult protective services

Purpose

            Appropriates $3,000,000 and 43 full-time equivalent positions (FTE positions) from the state General Fund (state GF) in FY 2022 to the Department of Economic Security (DES) for adult protective services.

Background

            DES is separated into seven divisions: 1) the Division of Aging and Adult Services; 2) the Division of Benefits and Medical Eligibility; 3) the Division of Child Support Services; 4) the Division of Developmental Disabilities; 5) the Division of Employment and Rehabilitation Services; 6) the Arizona Early Intervention Program; and 7) the Division of Community Outreach. DES administers employment services, individual and family services, income maintenance services, rehabilitation services, administrative services, manpower planning, economic opportunity services, intellectual disability and other developmental disability programs and nonmedical home and community-based services. DES is administered by a Director who is appointed by the Governor and approved by the Senate.

            A DES adult protective services worker must: 1) receive reports of abused, exploited or neglected vulnerable adults; 2) receive oral or written information about an adult who may be in need of services; 3) make an evaluation to determine if the adult is in need of protective services; 4) offer whatever services are deemed appropriate to the adult in need of protective services; and
5) file petitions, when necessary, for the appointment of a guardian, conservator, temporary guardian or temporary conservator (A.R.S. § 46-452).

            According to the Joint Legislative Budget Committee the FY 2022 baseline includes $8,731,900 from the state GF for adult services (JLBC).

            S.B. 1321 appropriates $3,000,000 and 43 FTE positions from the state GF in FY 2022 to DES.

Provisions

1.   Appropriates $3,000,000 and 43 FTE positions from the state GF in FY 2022 to DES for adult protective services.

2.   Becomes effective on the general effective date.
