FACT SHEET FOR S.B. 1302

 

CTEDs; average daily membership.

Purpose

            Allows students in approved career technical education (CTE) programs to generate an average daily membership (ADM) for instruction received during any hour of the day, during any day of the week at any time between July 1 and June 30 of each fiscal year. Specifies career and technical education districts (CTEDs) can operate for less than 180 days per year.

Background

             CTEDs deliver specialized vocational CTE courses to high school students. CTEDs and member school districts may allow any student to enroll in a CTE course or program without regard to age or high school graduation. A CTED, or school district or charter school that is a part of a CTED, must only include students in grades 10 through 12 in the calculation of student count or ADM. Students included in the student count must be enrolled in courses jointly approved by the governing boards for satellite courses taught within a district or charter school, or courses solely approved by the CTED for centrally located courses (A.R.S. § 15- 393).

            Currently, the ADM for a student in grades 10 through 12 enrolled in a course that meets for at least 150 minutes per class period is as follows: 1) 0.75 for students enrolled at a centralized campus; or 2) up to 0.75 for students enrolled at a leased centralized campus. Students in an approved CTED centralized program may generate an ADM during any day of the week at any time between July 1 and June 30 of each fiscal year. CTEDs may operate for more than 180 days per year, with expanded hours of service (A.R.S. § 15- 393).

            There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Generates an ADM for instruction received during any hour of the day, during any day of the week at any time between July 1 and June 30 of each fiscal year for students in approved CTE programs provided by a satellite, centralized or leased centralized campus. 

2.   Prohibits the Arizona Department of Education from restricting the instructional time by limiting the days of the week or times of the fiscal year when instruction can occur.

3.   Limits the amount of ADM generated for instruction received during any hour of the day, during any day of the week.

4.   Allows a CTED to operate for less than 180 days per year.

5.   Prohibits CTED ADM from being calculated on the 100th day of instruction.

6.   Calculates CTED ADM by dividing the instructional hours of enrollment by 600 hours, except that:

a)   0.25 ADM is generated for between 150 hours and less than 300 hours;

b)   0.5 ADM is generated for between 300 hours and less than 450 hours;

c)   0.75 ADM is generated for between 450 hours and less than 600 hours; and

d)   1.0 ADM is generated for over 600 hours.

7.   Establishes the ADM for a student enrolled in a CTE course or program provided by a community college as 0.25 for the accumulation of every three community college credits.

8.   Contains a legislative findings and intent clause.

9.   Makes technical and conforming changes.

10.  Becomes effective on the general effective date.

 

Amendments Adopted by Committee of the Whole

1.   Allows CTE students to generate an ADM for instruction received during any hour of the day.

 

2.   Specifies that the amount of ADM generated by CTE students for instruction received during any time of the fiscal year is limited.

 

3.   Prohibits CTED ADM from being calculated on the 100th day of instruction and specifies how a CTED's ADM is calculated.

 

4.   Establishes the ADM amount for a student enrolled in a CTE course or program provided by a community college.
