SB 1714: campaign expenditures; out-of-state; disclosures

Overview

Makes several changes and additions to statute regarding campaign expenditures for out-of-state contributors as it relates to advertisements.

History

Current statute requires a person that makes an expenditure for an advertisement or fundraising solicitation to include the words "paid for by" followed by the name of the person making the expenditure and whether the expenditure was authorized by any candidate, followed by the identity of the authorizing candidate.  In addition to these requirements, a political action committee (PAC) that makes an expenditure for an advertisement must include a disclosure that states the names of the three PACs making the largest aggregate contributions to the PAC making the expenditure and that exceed $20,000 during the election cycle.

In addition to other statutory requirements, if the advertisement is:

1)   Delivered by hand or mail or electronically, the disclosure must be clearly readable;

2)   Displayed on a sign or billboard, the disclosure must be displayed in a height that is at least 4% of the vertical height of the sign or billboard; and

3)   Broadcast on television or in a video or film, the written disclosure statement must be printed in letters that are displayed in a height that is at least 4% of the vertical picture height (A.R.S. § 16-925).

Provisions

1.   Requires a PAC that makes an expenditure for an advertisement to include a disclosure that states:

a)   The names of the three PACs that make the largest aggregate contributions if those aggregate contributions exceed $20,000 during the election cycle; and

b)   The aggregate percentage of out-of-state contributors as calculated at the time the advertisement was distributed for publication, delivery, display or broadcast.  The disclosure must state "Paid for by _________ with ____% from out-of-state contributors" with the blank to be filled with the aggregate percentage. 2.   Stipulates that if the advertisement is paid for by a PAC, the disclosure must be displayed in a height that is at least 10% of the vertical height of the advertisement. (Sec. 1)

3.   Specifies that the disclosure must be clearly readable if delivered electronically. (Sec. 1)

4.   Instructs the disclosure to be displayed in a height that is at least 10% of the vertical height of the sign or billboard if the advertisement is paid for by a PAC. (Sec. 1)

5.   States that if the advertisement is paid for by a PAC, the written disclosure on a broadcast must be displayed in a height that is at least 10% of the vertical picture height. (Sec. 1)
