SB 1680: newborn screening program; testing

Overview
Requires the Newborn Screening Program (Program) to include all congenital disorders included on the Recommended Uniform Screening Panel (RUSP). Requires additional conditions to be added to Arizona's newborn screening panel.
History
The Director of the Arizona Department of Health Services (Director, DHS) is required to establish a Program within DHS to ensure that the currently required testing for congenital disorders and the reporting of hearing test results for newborns are conducted in an effective and efficient manner.
The Director must establish a committee to provide recommendations and advice to DHS at least annually regarding tests the committee believes should be included in the Program. If the committee recommends a test be added to the Program, a cost-benefit analysis must accompany the recommendation. Statute outlines committee membership (A.R.S. § 36-694).
The Director is permitted to establish, by rule, a fee DHS may collect for operation of the Program, including contracting for testing. The fee for the first specimen and hearing test cannot exceed $36 (A.R.S. § 36-694). The Newborn Screening Program Fund (Fund) is administered by DHS and consists of collected fees, gifts and donations. Fund monies must be used to support the operation of the Program and are exempt from lapsing (A.R.S. § 36-694.01).
RUSP is a list of disorders that the Secretary (Secretary) of the U.S. Department of Health and Human Services recommends for states to screen for as part of their universal newborn screening programs. Disorders on the RUSP are chosen based on evidence that supports the potential net benefit of screening, the ability of states to screen for the disorder and the availability of effective treatments. It is recommended that every newborn be screened for all disorders on the RUSP. While states ultimately decide which disorders to screen for, RUSP establishes a standardized list supported by the Advisory Committee on Heritable Disorders in Newborns and Children and recommended by the Secretary.
Provisions
1.
Requires the Program to include all
congenital disorders included on the RUSP for both core and secondary
conditions. (Sec. 1)
2. Stipulates that, beginning January 1, 2022, disorders that are added to the core and secondary conditions list of the RUSP must be added to Arizona's newborn screening panel within two years after their addition to the RUSP. (Sec. 1)
3. Removes language that:
a) Outlines committee membership;
b) Caps the fee for the first specimen and hearing test at $36; and
c) Requires the committee to accompany recommendations with a cost-benefit analysis. (Sec. 1)
4. Requires the Director to present any change to the fee for the Program to the Joint Legislative Budget Committee for review. (Sec. 1)
5. Requires, no later than 60 days after DHS adjusts the Program fee:
a) Each health insurer that is subject to insurance statutes to update their hospital rates that include newborn screening to reflect the increase; and
b) The Arizona Health Care Cost Containment System (AHCCCS) and its contractors to update their hospital rates that include newborn screening to reflect the increase. (Sec. 1)
6. Specifies the Fund may consist of grants. (Sec. 2)
7. Mandates DHS, by December 31, 2021, add spinal muscular atrophy and x-linked adrenoleukodystrophy to Arizona's newborn screening panel. (Sec. 3)
8. Directs DHS to add, by December 31, 2023, all remaining core and secondary conditions included on the RUSP adopted by the Secretary as of December 31, 2021 to Arizona's newborn screening panel. (Sec. 3)
9. Contains a legislative intent clause. (Sec. 4)
