SB 1652: appropriations; attorney general; investigation; litigation

Overview

Appropriates $1 million from the state General Fund (GF) to the Attorney General (AG) in fiscal years (FY) 2022 and 2023.

History

The AG serves as the chief legal officer of Arizona. The AG is mandated by the Arizona Constitution and elected to serve a four-year term. The AG may: 1) serve as the legal advisor of the department of this state and render such legal services as the departments require; 2) represent political subdivisions, school districts and municipalities in suits to enforce state or federal statutes pertaining to antitrust, restraint of trade or price-fixing activities or conspiracies; and 3) develop and distribute to all state agencies, departments, boards, commissions, councils and other government entities an Arizona agency handbook that explains the major state laws that govern state agencies (A.R.S. § 41-192).

The AG is authorized to enforce the laws related to elections through civil or criminal actions in any election for state office, members of the Legislature or statewide initiative or referendum (A.R.S. § 16-1021).

Laws 2020, Chapter 58 provided $530,000 to the AG for a voter fraud unit. This funding supports the development of a public complaint process for allegations of voter fraud and for the investigation of those allegations by the Attorney General (JLBC FY 2021 Appropriations Report).
