SB 1429: solid waste services; private provider

Overview

Prohibits a county or municipality from providing for a criminal penalty against someone who refuses to purchase solid waste collection services from a private provider unless that provider contracted with a county or municipality to provide these services.

History

A county or municipality can establish regulations for private collection of solid waste within its jurisdiction. These entities can also provide for criminal and civil penalties for violating ordinances or regulations if the penalties do not exceed the penalties established in Arizona's solid waste management law (A.R.S. § 49-765)

Solid waste is statutorily defined as any garbage, trash, rubbish, waste tire, refuse, sludge from a waste treatment plant, water supply treatment plant or pollution control facility or other discarded material, including solid, liquid, semisolid or contained gaseous material. Statute exempts certain substances, materials and discharges from the statutory requirements and prohibitions for solid waste (A.R.S. § 49-701.01).
