Summary of the Strike-Everything Amendment to SB 1387
Overview
An emergency measure that allows dentists and dental hygienists to administer vaccines during a declared local, state or national emergency.
History
The State Board of Dental Examiners (Board) regulates and licenses dental professionals, including dentists, dental hygienists, dental consultants, dental therapists and denturists. Additionally, the Board reviews complaints against licensees and business entities, conducts investigations and is authorized to take disciplinary action for violations of state laws relating to the profession (A.R.S. §§ 32-1201 through 32-1299.26). The Board's membership consists of six licensed dentists, two licensed dental hygienists, two public members and one business entity member appointed by the Governor for a term of four years (A.R.S. §32-1203).
Provisions
1.
States that during a declared local,
state or national emergency, a dental responder is deemed to be acting within
the bounds of the dental responder’s license when providing vaccines and dental
humanitarian medical care. (Sec. 1)
2. Allows dentists and dental hygienists to administer vaccines on completion of appropriate training. (Sec. 1)
3. Limits the vaccines that dentists and dental hygienists can administer to only the Influenza and Covid-19 vaccines and only to patients at least 18 years old. (Sec. 1)
4. States that vaccines may be administered by the dentist or may be delegated to a dental hygienist who is either:
a) Acting under the direct supervision of a dentist; or
b) Acting under general supervision if the supervising dentist who performed an examination of the patient in the preceding 12 months approves the patient for the administration of the vaccine by the dental hygienist under general supervision and documents this approval in the patient’s record. (Sec. 1)
5. Enables a dentist or dental hygienist who wishes to administer vaccines to be certified by the Board after meeting Board requirements for certification. (Sec. 1)
6. Mandates a dentist or dental hygienist who administers a vaccine to do all of the following:
a) Report to the state immunization information system established by the Arizona Department of Health Services;
b) Maintain a record of the immunization;
c) Notify the patient’s identified primary care provider or physician, within 24 hours after occurrence, of any adverse reaction that is reported to or witnessed by the dentist or dental hygienist and that is listed by the vaccine manufacture as a contraindication to further doses of the vaccine; and
d) Notify the vaccine adverse event reporting system in accordance with the recommendations of the United States Centers for Disease Control and Prevention’s Advisory Committee. (Sec. 1)
7. States that the Board must adopt rules for dentists and dental hygienists to administer vaccines that include all of the following:
a) Protocols in accordance with current United States Department of Health Services standards for adult immunizing practices;
b) Recordkeeping and reporting requirements;
c) Requirements and qualifications for dentists and dental hygienists to be certified;
d) Vaccine information and educational materials for those requesting vaccines and immunizations; and
e) Emergency management policies and procedures. (Sec. 1)
8. Allows the Board to appoint an advisory committee to assist the Board in adopting and amending rules and developing protocols relating to the administration of vaccines and certification requirements. (Sec. 1)
9. States that the Board or advisory committee appointed by the Board shall hold one public hearing before adopting the rules and any amendments to the rules. (Sec. 1)
10. Defines dental responder. (Sec. 1)
11. Exempts the Board from rulemaking requirements for one year after the effective date of this Act . (Sec. 2)
12. Contains an emergency clause. (Sec. 3)
